For this assignment, we want you to promote one of the top personalities in sports, baseball Hall of Fame third baseman Brooks Robinson.  Show us your skills by producing a :30-second video ad that convinces advertisers why Brooks is a great talent choice to use in their online advertising campaigns. After all, what advertiser wouldn’t benefit from having Brooks associated with their product or service?

Advertisements must be in the form of a thirty (30) second TV commercial.  Ads must be received no later than November 7, 2008 at 11:59 p.m. Eastern Standard Time (EST).

Ad Maker represents and warrants that: 

• the Ad is original to Ad Maker and has not previously won an award, been published or used by any third party;
•  he/she has obtained all necessary and required executed releases in connection with the Ad, including but not limited to photographic releases, location releases, photo releases and/or talent releases;
•  all persons engaged to work on the Ad and/or appear in the Ad (a) have no payment claims against Ad Maker, Licensed Parties, or the Sponsor; (b) have no rights of consultation or approval; and (c) are not parties to or have been engaged pursuant to any union or guild agreement; and

By submitting the Ad to XLNTads / Poptent, Ad Maker transfers any and all right, title and interest in and to the Ad and any and all portions thereof, including but not limited to any and all copyrights, trademarks, “moral rights” and any and all other rights that may exist, throughout the world, to Sponsor. As the exclusive owner of all rights in and to the Ad, Ad Maker agrees that Sponsor will have the worldwide, perpetual right to copy, display, reproduce, exhibit, edit, modify, assign, license, register for copyright or trademark, distribute, sell or otherwise use and exploit the Ad and all elements and/or derivative works thereof, in whole or in part, alone or with other materials, in any media now known or hereafter created or devised, for any reason whatsoever.

Ad Maker agrees that all Ads will be owned by Sponsor upon their submission to XLNTads / Poptent; provided that, notwithstanding such ownership, Sponsor and XLNTads agree to pay Ad Maker a one-time payment of One Thousand United States Dollars (US$1,000) (“Use Payment”) prior to Sponsor’s first use, broadcast or other exploitation of the Ad (not including the posting of such Ad on the XLNTads’ Poptent web site). The Use Payment is the sole and exclusive payment Ad Maker is entitled to receive under this Agreement. Ad Maker shall be responsible for all and any income taxes related to the receipt of the Use Payment.

XLNTads will notify Ad Maker if Sponsor elects to use the Ad. Ad Maker acknowledges and agrees that (i) (i) Ad Maker will immediately supply written executed copies of the Sponsor Agreement, releases and other documentation upon Sponsor’s request;  Ad Maker has no consultation or approval rights over the use of the Ad or Ad Maker’s name, portrait, appearance, likeness or biographical information therewith.

Payments: BAT will purchase 2 videos at $1000 each.
